However, the courts have also held that medical marijuana use can be used as a reason to remove kids, where the marijuana use presents a non-speculative risk of harm to the children.<br /><br />If parents are using marijuana in the presence of children or are impaired around their kids, then that might be sufficient reason to justify removal.<br /><br />Our state allows the use of medical marijuana in children, but in the case of a foster child, permission would have to come by way of court order, and couldn't be authorized by a birth parent, foster parent or social worker. Generally speaking, it's pretty tough to get permission for medical marijuana for minor kids.
